New book 'Hot Topics in the Legal Profession - 2012' and old classic 'The Bramble Bush'

As promised last weekend, I announce a book truly on-topic for LPB. This is a collection of essays, on ethics and broader issues of the U.S. profession, from students in my Advanced Professional Responsibility Seminar last year. I added an intro but really the substance is in their 14 chapters. Their topics include:

...false guilty pleas and candor to the court, ethical considerations in keeping the client's files as a digital record, legal outsourcing and competition, the dilemma of student debt in a slowed legal economy, the practice of law by legal websites like LegalZoom, the capital defense of Jared Lee Loughner, Justice Scalia's constitutional seminar for conservative congressmembers, sensitivity to "cultural competence" in legal education and practice, prosecutorial relationships with key witnesses, bar discipline for behavior outside the practice of law, negotiation ethics, hybridized MDL settlements, and the advocate-witness rule.

It is available now in paperback at Amazon or the QP page; plus such eBooks as Kindle and Nook, and at Apple iBooks and iTunes bookstores. Proceeds benefit Tulane's Public Interest Law Foundation, so even if it is not a book you'd buy or download for yourself, please consider asking the law library to acquire a paperback.

Also out is the eBook of an old but amazingly relevant book of advice for prelaw and 1L law students, Karl Llewellyn's The Bramble Bush (e.g., in Kindle). I was pretty amazed he discussed active learning, visualizing case facts, better note-taking, and a script for case-briefing and the uses of precedent. Still is a perennial recommended read for the summer before law school, on lots of lists. This classic had not been released in eBooks before today. Sort of odd how little 1L classes and reading have changed.

Murdoch's firm settles 9 phone hacking lawsuits (AP)

LONDON ? Nine more phone hacking lawsuits against Rupert Murdoch's News International have been settled, including a case brought by comedian Steve Coogan, his lawyer told Britain's High Court on Wednesday.

That brings to more than 60 the number of claims that Murdoch's UK newspaper company has dealt with in the scandal that has already brought down a 168-year-old tabloid and threatened Murdoch's global media empire.

But Murdoch's company still faces a host of other lawsuits linked to journalists obtaining scoops using illegal means. Hugh Tomlinson, the lawyer for the victims, said six more new lawsuits had been filed and 50 other cases are being prepared.

The cases settled recently include Coogan, who received a settlement of 40,000 pounds ($63,500) and soccer star Paul Gascoigne, who received 68,000 pounds ($108,000).

Simon Hughes, deputy leader of the Liberal Democrat party, received 45,000 pounds ($71,500) and said in a statement that everyone who allowed a large company to behave illegally must be brought to account.

Lawmaker George Galloway received 25,000 pounds ($39,700) and News International lawyer Michael Silverleaf admitted the company had intercepted five of Galloway's voicemails around the time of the 2003 Iraq war.

Sally King, a friend of former Home Secretary David Blunkett, received 60,000 pounds ($95,300) while her husband Andrew received 50,000 pounds ($79,400). Her father and brother also received substantial damages.

Sports agent Sky Andrew also received 75,000 pounds.

Silverleaf said in court that News International had accepted responsibility and regretted the damage it had caused.

The only outstanding case from the first set of phone hacking claims was brought by singer Charlotte Church, who has testified that Murdoch's reporters grossly violated her privacy and that of her family, causing great distress.

The scandal over phone hacking at the News of the World tabloid boiled over after it emerged last summer that journalists at the paper had routinely hacked into the phones of celebrities, politicians, sports figures and even crime victims.

The now-defunct tabloid has already settled with several prominent figures, including actress Sienna Miller and the family of murdered British schoolgirl Milly Dowler, whose phone was broken into by the paper soon after her disappearance in 2002.

The Cranberries ? Zombie Guitar Chords Entertainment Arts Music

Rice honoring David Wilganowski?s scholarship the heart-warming winner of national signing day

When national signing day comes along each year, Rice isn't exactly the first school to garner major press attention. "The Harvard of the South" (or Southwest, if you prefer) tends to recruit and lock up its future players on its own terms well in advance of the late signing season push.

Yet this year, Rice got some attention for doing what would be unthinkable at a most schools: They gave a full scholarship to a teenager they know won't ever play a down for the Owls.

As first reported by KHOU, one of the members of Rice's incoming class of football players is Bryan (Texas) Rudder High defensive end David Wilganowski, a player who first gained major attention in September when he collapsed during a game and required emergency intervention to save his life. After being shocked with an automatic external defibrillator on the field, Wilganowski was flown to Houston, where it was later determined that his heart had given out and he would require a defibrillator to be implanted into his chest.

That procedure is being credited with saving and stabilizing his life, yet it also profoundly changed it: The chest-bound defibrillator essentially ensured that Wilganowski would never play football again. With the senior already having committed to Rice, it was understandable that he was concerned that he would lose his spot in the school's incoming Class of 2016.

It turns out Wilganowski was wrong to ever doubt Rice at all. The school honored it's scholarship to the teen, a pact that was made official on signing day when Wilganowski officially became a part of the school's football program, albeit knowing that he would take on a different role than he ever imagined on campus next fall.

"We ask young men to keep their word to us, you know we say we're going to be with them through thick or thin," Rice football coach David Bailiff told KHOU. "I think it's a good practice that you keep your word."

As for Wilganowski, while he may still be getting used to the idea that he'll never again play the sport he loves, he was openly confident that he would play an important part in the team's future during his four-year tenure at the school.

His father, also named David, was even more emphatic about how he felt about the school.

"I'm really happy that Rice honored his commitment," the elder David Wilganowski told KHOU. "God bless Rice."

Original 'Living Dead' zombie dies at 75

He wasn't the first-ever movie zombie, but he was the first to appear in George A. Romero's 1968 classic, "Night of the Living Dead."

Actor Bill Hinzman has died of cancer at 75, horror site Dread Central is reporting.

His character, dubbed the Graveyard Zombie, makes an appearance early in the film, staggering towards brother and sister Barbara and Johnny in a cemetery, and killing Johnny. The line, "They're coming to get you, Barbara" is famously delivered by Johnny just before?Hinzman comes after the siblings.

Other creatures called zombies had been depicted in film, but it was Romero who introduced the slow-walking, flesh-eating undead that we now think of when we hear the term. The movie is a cinema classic, and thousands of variously decaying zombies have attacked humans in films since then, but Hinzman was the first.

Dread Central?had high praise for Hinzman. "Afixture on the convention circuit, Bill was always there with a smile for fans, often appearing in costume as the famed ghoul we all grew up with," site contributor Uncle Creepy (!) wrote.

Hinzman later acted in other horror films, and wrote, produced, edited, directed and starred in 1988's "Flesh Eater," in which he appears to play the same zombie from "Night of the Living Dead." He continued to represent the film that made him famous, even answering questions at a Chicago production of "The Musical of the Living Dead."

'Tebowing' Alec Baldwin hosts NFL Honors (AP)

INDIANAPOLIS ? Trying to do his best "Tebowing," Alec Baldwin got a bit of help on stage.

The host of "NFL Honors" on NBC was kneeling down when Denver Broncos quarterback Tim Tebow stepped up and showed Baldwin how it's really done.

"Bless you, Tim," Baldwin responded.

That capped a nearly 10-minute monologue Saturday night on the eve of the Super Bowl as The Associated Press awards for the 2011 season were announced.

Baldwin started by walking into the glittery crowd, handing a football to Green Bay quarterback Aaron Rodgers and asking the AP NFL Most Valuable Player to sign it.

The "30 Rock" star then tossed around the jokes, taking equal shots at the NFL, Madonna and the Kardashians, mostly to big laughs from the likes of Joe Namath, Rex Ryan and Cam Newton. All the while, Baldwin clutched his prized souvenir.

The evening's first presenter, Katy Perry, kept in the spirit.

"Hi Tim, my parents said hi," Perry told Tebow. Both of the 27-year-old singer's parents are pastors ? Tebow was raised by missionary parents.

Early in his monologue, Baldwin pretended he saw Madonna ? who's performing at halftime of the game between the New England Patriots and New York Giants in the audience. He pointed out it was instead Packers linebacker Clay Matthews.

"I was confused by the hair and biceps," he said to a roomful of laughs. Matthews, for the moment, didn't look too amused.

Baldwin jabbed a famous reality show family, too. Mentioning the power and popularity of the NFL, "It would take 800 years for the Kardashians to date and destroy all of them."

But Baldwin did not spare the NFL.

He told the audience New England coach Bill Belichick was tucking in his Patriots and telling them that Giants coach Tom Coughlin was not hiding in their closet.

He joked about the NFL lockout, saying fans would've had to resort to watching Canadian football with teams with silly names such as the Argonauts.

And he compared Philadelphia quarterback Vince Young's preseason comments of being on a dream team with a bad dream ? the nightmare of being naked in school. The Eagles lost four of their first five games.

After the award for the AP Defensive Rookie of the year, Baldwin sat next to former NFL star Archie Manning and asked him: "Peyton or Eli?"

Rather than choose between his quarterback sons, Manning offered a quick retort.

"Let me ask the question: Alec or Billy?" Manning said.

Conveniently, the younger Baldwin brother was sitting right in front of Alec.

As for the postgame altercation between coaches Jim Harbaugh of the 49ers and Jim Schwartz of the Lions, "I haven't seen a handshake that awkward since Nixon met Elvis."

Before the show, players were eager to hear Baldwin's take on the NFL.

"He'll say anything but he's always funny," Jacksonville Jaguars running back Maurice Jones-Drew said.

The evening's presenters included television host Jimmy Fallon, "Mad Men" star Jon Hamm and "Entourage" actress Emmanuelle Chriqui.
